By accessing or using any fidubond product (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.
These Terms apply to all products operated by fidubond (fidubond.com), including:
You must be at least 18 years old and legally able to enter into contracts. If you use the Service on behalf of an organization, or as a fiduciary (guardian, attorney-in-fact, trustee, or LPA attorney) for another person, you represent that you have the legal authority to act in that capacity and to bind that person or organization to these Terms to the extent applicable.
fidubond grants you a personal, non-exclusive, non-transferable, revocable license to access and use the Service for your own fiduciary record-keeping purposes. Recording is free. Paid features (PDF export, compliance reports) require an annual license pursuant to the plan you purchase (annual license per ward, principal, trust, or donor, as described on each product's pricing page).
Each license is for a single fiduciary relationship (one ward, one principal, one trust, or one donor). You must purchase a separate license for each additional relationship.
For complex situations — court disputes, IRS audits, multi-state tax questions, eligibility determinations for SSI/Medicaid — consult a qualified attorney, CPA, or benefits counsellor licensed in your jurisdiction.
The compliance checking, pre-check, and authority matrix features provide general educational information based on public SSA POMS and UPOAA references. They do not constitute legal compliance determinations. The actual legal effect depends on your specific document, state law, and individual circumstances. You must independently verify all legal determinations with a qualified attorney.
Generated documents: Documents produced by the Service (court reports, LPA draft forms, POA summary letters, annual accounts, distribution records) are structured reference documents generated from your input data. They are not official court forms, not OPG forms, and not government-issued documents. You are solely responsible for verifying their accuracy, completeness, and suitability before submitting them to any court, agency, or institution.
Recording transactions, decisions, and timeline events is free of charge. No payment method is collected for basic recording. Premium features (PDF export, compliance dashboards, pre-check) require an annual license.
All payments are processed by Creem.com Market Limited as the Merchant of Record. Creem is the legal seller of the paid Service; fidubond is the supplier. Creem handles payment collection, sales tax/VAT/GST calculation and remittance, invoicing, and chargeback disputes on our behalf.
Each product is offered as an annual license that renews automatically on the same calendar day each year until you cancel. You can cancel at any time from your account settings or by contacting Creem support; cancellation takes effect at the end of the current billing period. You retain access to the Service until the end of the paid period.
We may change prices with at least 30 days' notice. Existing subscribers keep the current price for the remainder of the current billing cycle; the new price applies from the next renewal.
All purchases are final and non-refundable. You have the opportunity to evaluate the Service during a 14-day free trial before purchasing. Once you complete a purchase, no refund is available — whether in full or in part. If you cancel mid-cycle, you retain access until the end of the paid period, but no prorated refund is issued. All product data (your transactions, decisions, contacts, and generated records) is stored locally in your browser using IndexedDB and OPFS storage. We do not upload, store, or have access to your product data. See our Privacy Policy for full details.

The Service, including all software, templates, document formats, and rule databases, is the intellectual property of fidubond. Documents you generate using the Service belong to you; the underlying templates and rule logic remain our property.
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be error-free, that compliance rules are current, or that generated documents will be accepted by every court, agency, or IRS office.
To the maximum extent permitted by law, fidubond and its suppliers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising from your use of the Service. Our total aggregate liability for any and all claims arising from these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim, limited to the annual license fee you paid for the specific product through which the claim arose.
You acknowledge that the compliance rules, POMS references, and authority matrices are informational tools that may contain errors or omissions. Fidubond does not warrant that the rule library is current, complete, or applicable to your specific situation.
Exclusion of consequential damages: In no event shall fidubond be liable for loss of SSI or Medicaid benefits, loss of court filings, loss of trust assets, tax penalties, or any other consequential damages arising from reliance on the Service's compliance checks, pre-check results, authority matrix, or generated documents. The Service provides informational references only, not legal compliance determinations.
These Terms are governed by the laws of England and Wales, without regard to conflict-of-law principles. The courts of England shall have exclusive jurisdiction over any disputes arising from these Terms.
We may update these Terms from time to time. We will notify users of material changes by posting a notice on the homepage at least 30 days before the changes take effect.

Any dispute arising from these Terms or the Service shall first be submitted to mediation. If mediation fails within 30 days, the dispute shall be resolved by arbitration in London, England, under the Arbitration Act 1996. Each party bears its own costs unless the arbitrator determines otherwise. This clause does not affect your statutory rights as a consumer under applicable UK law.
You and fidubond agree that any dispute shall be brought individually and not as a class action, collective action, or representative proceeding. You and fidubond expressly waive the right to participate in a class action, collective action, or representative proceeding. This clause does not affect your statutory rights as a consumer under applicable UK law, including the right to seek redress through alternative dispute resolution schemes approved by the UK Financial Conduct Authority or the Competition and Markets Authority.
If you do not agree to these terms, do not complete the purchase. You may use the recording features of the Service free of charge without obligation.
